Minor corrections 

On 14 March 2022, the Ōmāhu Residential Development expert consenting panel reissued the conditions of consent after making minor corrections to the consent conditions, in accordance with clause 40 of Schedule 6 of the Act. These conditions of consent supersede and replace the consent conditions issued with the decision released under clause 37 of Schedule 6 of the Act on 15 February 2022.

On 25 February 2022, the applicant requested minor corrections under clause 40 of Schedule 6 of the Act, to the final consent conditions issued under the decision on the Ōmāhu Residential Development.

The decision

The expert consenting panel appointed to determine the Ōmāhu Residential Development application has completed its consideration of the application and has made its final decision.

The application by Urban Resort Limited and Icon Co Pty (NZ) Limited for the Ōmāhu Residential Development has been granted subject to conditions.

Appealing the decision

The panel’s decision can be appealed to the High Court in whole or in part on questions of law only.

Any of the following may appeal:

• the consent applicant or requiring authority, as the case requires
• any relevant local authority
• the Attorney-General
• any person or group that provided comments in response to an invitation given under clause 17(2)
• any person who has an interest in the decision appealed against that is greater than that of the general public.

A notice of appeal must be filed with the Registrar of the High Court within 15 working days after the date the person is notified of the panel’s decision. A copy of the notice of appeal must also be served on the EPA.
