The expert consenting panel appointed to determine the Federal Street residences application has made its decision.
On 24 August 2022, the panel made minor corrections to Condition 1 of the conditions of consent issued with the decision on 28 July 2022. These corrected conditions of consent supersede the conditions of consent issued with the decision on 28 July 2022.
On 28 July 2022, the panel made its decision in accordance with clause 37 of the COVID-19 Recovery (Fast-track Consenting) Act 2020.
The panel grants resource consents subject to conditions for the Federal Street residences project to P0012 Auckland NZ Pty Limited.
The panel’s decision can be appealed to the High Court in whole or in part on questions of law only. Any of the following persons may appeal:
(a) the consent applicant or requiring authority, as the case requires
(b) any relevant local authority
(c) the Attorney-General
(d) any person or group that provided comments in response to an invitation given under clause 17(2)
(e) any person who has an interest in the decision appealed against that is greater than that of the general public.
A notice of appeal must be filed with the Registrar of the High Court within 15-working-days after the date the person is notified of the panel’s decision. A copy of the notice of appeal must also be served on the EPA.
