On 3 June 2021 the panel resolved to make minor corrections to the conditions of the resource consents in their decision, to correct cross referencing errors in the decision. The amended decision of the Expert Consenting Panel released on 3 June 2021 supersedes and replaces the Waitohi Picton ferry redevelopment decision report released on 6 May 2021.
On 3 June 2021, Minute 5 was issued by the Expert Consenting Panel. This Minute outlines their decision to make minor corrections.

The Expert Consenting Panel appointed to determine the Waitohi Picton Ferry Precinct Redevelopment application has completed its consideration of the application and has made its final decision.
On 6 May 2021, the Expert Consenting Panel granted the resource consents subject to conditions, to KiwiRail Holdings Limited, Port Marlborough New Zealand and Marlborough District Council, authorising the redevelopment of the Waitohi Picton Ferry Precinct.

The Expert Consenting Panel’s decision can be appealed to the High Court in whole or in part on questions of law only.
Any of the following persons may appeal:
(a) the consent applicant or requiring authority, as the case requires
(b) any relevant local authority
(c) the Attorney-General
(d) any person or group that provided comments in response to an invitation given under clause 17(2)
(e) any person who has an interest in the decision appealed against that is greater than that of the general public.
A notice of appeal must be filed with the Registrar of the High Court within 15 working days after the date the person is notified of the Expert Consenting Panel’s decision. A copy of the notice of appeal must also be served on the EPA. Appeals can be served on the EPA by sending them to waitohifasttrack@epa.govt.nz or by post to:
