The Expert Consenting Panel (the Panel) appointed to determine the Queenstown arterials resource consent application and notice of requirement has completed its consideration of the application and has made its final decision.
The EPA received a request from the legal counsel for the Hall family Trust (being a party from whom comment was invited in accordance with clause 17(2) of Schedule 6 of the Act), to amend condition 1(a) of the confirmed Notice of Requirement.

The EPA passed the request to the Panel, who in accordance with clause 40 of Schedule 6 of the Act, resolved to make a minor correction to condition 1(a) of the confirmed Notice of Requirement. A Minute detailing this decision and the panels consideration was released on 10 May 2021.

On 10 May 2021, the Panel issued an amended Notice of Requirement, with updated conditions for the Queenstown Arterials Project, following a minor correction to Condition 1(a) of the Notice of Requirement. As such, the below link to the amended version of Appendix 1 to the “Record of Decision” (which was released on 16 April 2021), supersedes and replaces “Appendix 1 – NOR confirmed and consents granted and conditions imposed” released on 16 April 2021.

On 16 April 2021 the Expert Consenting Panel granted, subject to conditions, Queenstown Lakes District Council resource consents to construct the Queenstown Town Centre urban arterials road, and confirmed the notice of requirement subject to conditions.

The Expert Consenting Panel’s decision can be appealed to the High Court in whole or in part on questions of law only.
Any of the following persons may appeal:
(a) the consent applicant or requiring authority, as the case requires
(b) any relevant local authority
(c) the Attorney-General
(d) any person or group that provided comments in response to an invitation given under clause 17(2)
(e) any person who has an interest in the decision appealed against that is greater than that of the general public.
A notice of appeal must be filed with the Registrar of the High Court within 15 working days after the date the person is notified of the Expert Consenting Panel’s decision. A copy of the notice of appeal must also be served on the EPA.
